I don't understand.  If the Linux kernel violates SCO's "intellectual 
property" (not sure any intellectuals actually work there any more) then why 
do they keep distributing it?

Download kernel SRPM from SCO, since they claim to own all computer code.
ftp://ftp.sco.com/pub/updates/OpenLinux/3.1.1/Server/current/SRPMS/linux-2.4.13-21S.src.rpm
 
Make sure you are in the directory you want to extract the kernel source to

rpm2cpio linux-2.4.13-21S.src.rpm | cpio -i
tar -xvjf linux-2.4.13.tar.bz2

You now have the SCO released exact copy of the linux 2.4.13 source from 
kernel.org.
